• The Office of Competition and Consumer Protection adopted three decisions on concentration approval.
• The decisions in question pertain to undertakings operating in the real estate development, IT and receivables management sectors.
• The undertakings have two years from the date of the decision to complete the transactions.

The first of the concentrations in question is the takeover of Macrologic by Asseco Business Solutions. Both undertakings engage in the provision of services which involve the design and implementation of IT solutions. Their offer is aimed, among others, at the financial sector, banking sector, public institutions, healthcare sector, trade sector and industry.

The second contemplated transaction which has been authorised is the takeover of mLocum (Łódź) by Archicom (Wrocław). Both companies are real estate developers who construct, lease out and sell residential and commercial properties. Archicom’s main geographic market is the city of Wrocław, while mLocum focuses on the primary real estate market in Łódź, Warsaw, Cracow, Wrocław, Poznań and the Tri-City area (Gdańsk, Gdynia and Sopot).

The third authorisation pertains to the takeover of control over EGB Investments by GetBack. GetBack forms part of the Abris Group and engages in business activities which involve the buying and selling as well as management of receivables acquired by investment funds. EGB Investments is a debt recovery company which provides support to banks, financial institutions, corporations and other undertakings in the field of receivables management.

According to the provisions of applicable laws, the merger is subject to notification to the antitrust authority if it involves undertakings whose aggregate turnover generated in the preceding year exceeded EUR 1 billion worldwide or EUR 50 million in Poland.

The decisions approving the concentration expire if the merger is not completed within 2 years of the adoption thereof. The website of the Competition Authority publishes information on all concentration-related anti-monopoly proceedings conducted by the Authority.
