Jastrzębska Spółka Węglowa permitted to acquire the Knurów-Szczygłowice mine from Kompania Węglowa. The transaction is not going to result in restricting competition on a hard coal market whose coverage extends outside of Poland

An application filed by Jastrzębska Spółka Węglowa for the take-over of a portion of assets of Kompania Węglowa, namely, the Knurów-Szczygłowice hard was received by the Office of Competition and Consumer Protection on 29 April 2014. The entrepreneurs operate on the market of mining and marketing coaking coal and power coal. The application was filed based on a preliminary agreement for the sale of the mine.

The proceedings conducted by the President of the Office showed that the transaction is not going to result in restricting competition. The market of marketing the power coal and coaking coal has at least European or even global coverage. There are no import or export limitations and pricing is conditional upon global commodity markets. Moreover Jastrzębska Spółka Węglowa and the mine to be taken over sell the majority of mined coal abroad.

Pursuant to the law, the concentration is subject to notification to the anti-monopoly authority if it involves entrepreneurs whose combined turnover generated in the preceding year exceeded EUR 1 billion worldwide or EUR 50 million in Poland.

The decisions authorizing the concentrations expire if the mergers are not performed within 2 years from their issue. UOKiK’s website  publishes information on all concentration-related anti-monopoly proceedings conducted by the Office.
