The president of Poland’s Office of Competition and Consumer Protection (the UOKiK) has issued five concentration clearances. Participants in the transactions cleared include the companies Elekta, Tauron Polska Energia, ArcelorMittal, Polski Tytoń, SM Mlekovita and Mostostal Puławy

The first clearance concerns Elekta’s acquisition of the RTA company. Headquartered in Sweden, Elekta is the parent company of a capital group that manufactures and sells medical equipment used in the treatment of cancer and brain diseases. Elekta’s sole distributor in Poland, RTA’s core business is the wholesale distribution of medical apparatus and equipment in Poland. As a result of the concentration, Elekta will acquire full control of RTA.

Tauron Polska Energia and ArcelorMittal have been given the go-ahead to found a joint business. Tauron is a holding company that primarily generates, distributes and sells power in southern Poland while ArcelorMittal manufactures steel, iron ore and metallurgical coal. The joint business, Tameh Holding, will indirectly control two heat and power plants currently owned by the Tauron Group: Nowa in Dąbrowa Górnicza, and Blachownia in Kędzierzyn-Koźle, and two owned by ArcelorMittal:  Kraków in Cracow and Ostrava in Ostrava. Tameh Holding will supply utilities generated in the heat and power plants to designated customers.

Polski Tytoń (Polish Tobacco) has received the green light to take over Bluepay. Polski Tytoń is a nationwide wholesale distributor of tobacco products and fast-moving consumer goods. It also offers services in the retail sector through its multi-functional terminals. Bluepay offers top-ups for pre-paid mobile phones as well as electricity top-ups in the form of pre-paid cards.

The President of the UOKiK also agreed the merger of the SM Mlekovita (the Dairy Co-operative Mlekovita )and the Tomaszów Dairy Co-operative in Tomaszów Lubelski. Both businesses purchase and process milk and manufacture dairy products. The concentration will be based on co-operative law and ultimately only one entity – Mlekovita – will remain on the market.

Finally, High Business has been cleared to acquire Mostostal Puławy. High Business is currently not involved in any economic activity as it has been set up for the needs of the concentration. Mostostal Puławy principally does construction and design work.
