UPC Polska - UOKiK's decision

5 thousand zlotys – such was the penalty imposed by the UPC Polska TV operator for granting access to the Internet or connecting more computers or TV sets than stipulated in the contract. In the opinion of the Office, the penalty was too high and did not reflect the damage the company might suffer as a result of the consumers’ activity. UPC Polska committed to change this provision
The proceedings against UPS Polska were instigated in October 2013. The clause that raised doubts was a clause on the access to TV, Internet and telephone in the price list: Penalty for granting access to the Internet, DTV or telephone service outside the premises, illegal use of the network, connecting more computers than specified in the Technical Parameters – PLN 5,000.00.
In the opinion of the Office, the penalty is blatantly exaggerated and set arbitrarily – it does not reflect the actual damage that the entrepreneur might incur.
UPC Polska committed to modify the provision within three months as from the day the decision will become final and valid. New, modified clause in the UPC Polska’s contract will specify that the penalty should be equal to a monthly subscription fee per each person or entity to which the UPC Polska services were illegally granted.
