The situation on the coal market - explanatory proceedings

The Office of Competition and Consumer Protection has launched explanatory proceedings aimed at analysing the situation on the coal market. Above all, activities of distributors will be scrutinized.

UOKiK’s initiated explanatory proceedings to examine the condition of competition, concentration and market behaviours of entrepreneurs engaged in coal sales and distribution.

The analysis will be, above all, focused on the coal distribution within Poland, sales channels and methods. UOKiK will also examine, whether the pricing policy may give rise to doubts from the perspective of the protection of competition. In the course of the proceedings the Office will analyse pricing at individual links of the coal chain supply starting with producers, customers and resellers.

Any entities that have information pertaining to the pending proceedings may notify UOKiK’s Branch Office in Katowice - [SCODE]a2F0b3dpY2VAdW9raWsuZ292LnBs[ECODE].

Pursuant to the antimonopoly law, the Office may instigate explanatory proceedings which are always conducted in a given case instead of against a specific entrepreneur and their purpose is to initially examine the market situation. The explanatory proceedings should be completed within 30, and in particularly complicated cases - within 60 days from their commencement. The dates may, however, be extended, for example, if the Office awaits the delivery of requested information If in the course of the explanatory proceedings the President of the Office finds any irregularities he may institute antimonopoly proceedings concerning competition restricting practices.
