UOKiK wins in court - Motorway A4

Stalexport Autostrada Ma³opolska imposed unfair toll prices for driving on A4 motorway. Today, the Court of Appeal dismissed an appeal of the undertaking. The imposed financial penalty of PLN 1.3 million has also been maintained

The court's judgment concerns UOKiK’s decision of April 2008. The Office concluded that Stalexport Autostrada Ma³opolska had no right to charge the full toll for driving on the motorway, which did not meet in full the standard for this type of road. The court's judgment concerns UOKiK’s decision of April 2008. The Office concluded that Stalexport Autostrada Ma³opolska had no right to charge the full toll for driving on the motorway, which did not meet in full the standard for this type of road. Repair works on the section of the road lasting from January to September 2007 resulted in longer travel times and significant obstructions to the traffic. In the peak moment, at almost 1/3 length of the route between toll points there occurred two-way traffic on one roadway, and the travel time significantly extended. Stalexport Autostrada Ma³opolska was fined with PLN 1.3 million.

The undertaking exercised its right and appealed against the decision. In May 2010 the Court of Competition and Consumer Protection confirmed its decision. Stalexport Autostrada Ma³opolska filed an appeal against this decision - the Court of Appeals dismissed it on 31 May 2011. The court shared in full the standpoint of UOKiK, emphasizing that when setting the price for the travel, the undertaking should have taken into account the duration of the repairs. It also upheld the penalty imposed.

Pursuant to the law, the entrepreneur against whom the decision was made by the President of UOKiK, may appeal to the Court of Competition and Consumer Protection (CCCP). The decision of CCCP may be appealed against to the Court of Appeal.
