The spectre of collusion over a bid for keeping the roads in Tychy clean

- Has a bid rigging occurred with regard to roads maintenance in Tychy?
- UOKiK will decide it during its respective proceedings.
- The Office brought charges against five companies.
The Office of Competition and Consumer Protection has its suspicions as to the for “winter road maintenance, post-winter road clean-up and keeping roads clean and well-kept in the summer time” in Tychy in the years 2015-2018. A consortium of two companies, namely Bio-Ekos from Nowe Chechło and Eko Ogród from Tychy, submitted the most favourable and at the same time the lowest bid. However, it did not complete the necessary documents and thus failed to sign a contract. UOKiK suspects that this was a deliberate action aimed at making the contracting authority choose a higher bid made by another consortium consisting of the following companies: V&T from Tarnowskie Góry, Master Odpady i Energia from Tychy and An-Eko from Tychy.
We conducted a search of these companies’ premises and we found evidence that the consortia might have been involved in organizing collusive bidding schemes. The town of Tychy could have lost up to several million zlotys this way, says the President of UOKiK, Marek Niechciał.
