2nd phase of the proceeding between: Agora and Eurozet

- UOKiK referred the takeover of Eurozet by Agora to the second stage of proceedings.
- Thereupon, it is necessary to conduct a market research.
The application for consent to the transaction was filed with UOKiK on 28 October. Agora is the head of a capital group that mainly deals with press activity, publishing and radio broadcasting in addition to the sale of advertisements. Eurozet, on the other hand, produces and broadcasts radio shows (e.g. Radio Zet), sells commercial time and manages internet websites.
Business activity of the concentration participants overlaps on several markets, including radio shows broadcasting and online advertising, so their analysis is necessary.
We have to determine the shares of Agora and Eurozet on individual markets, compare them with the power of their competitors and check whether the competition of entrepreneurs is local or nationwide, says the President of UOKiK, Marek Niechciał.
The commencement of the second stage of the proceeding does not affect a decision to be made in the future. The President of the Office of Competition and Consumer Protection may give its consent (unconditional or conditional) to concentration or prohibit it. At this stage, the company may also withdraw the application. Pursuant to antitrust law, should this be the case, UOKiK will obligatorily discontinue the proceedings and the notified concentration will not take effect.

Pursuant to the Act on Competition and Consumer Protection, proceedings regarding concentration are two-stage. The first stage takes up to a month. However, in particularly complex cases, where there is a likelihood of a significant restriction of competition or where market research is requires, the proceedings may take more time.
