Summary of UOKiK's merger control proceedings in 2016

In the first half of 2016, Poland’s Competition Authority issued 96 concentration application approvals, mainly for companies in the automotive and energy industries. In some 10 cases, significant and extensive deficiencies in the application caused the Authority to return it.
Concentration proceedings consist of two phases. The first lasts up to 30 days and deals with cases in which it is clear that competition will not be negatively affected. More complicated proceedings—those requiring market study, for example—may be extended to a second phase, which lasts an additional four months.
UOKiK cleared 96 of the applications it received in the first half of the year, and 94 were concluded in the first, one-month phase, with one requiring only ten days. The other two were extended to the second phase. Ten decisions concerned the automotive industry, while another nine related to the energy market and seven to developer operations.
In addition to handling cases concerning Poland’s domestic market, UOKiK provides opinions in proceedings conducted by the European Commission on the impact concentrations would have on the Polish market. The Office received 169 such cases from the EC in the first half of 2016.
