UOKiK approves concentration on mining machinery market

Poland’s Office of Competition and Consumer Protection (UOKIK) has approved a concentration of mining machinery producers, Famur and Kopex. The transaction falls under a government programme that seeks to build strong Polish brands on foreign markets.

On April 21, 2016 UOKiK received a request from TDJ Equity IV, a subsidiary of TDJ, to acquire the company Partner. TDJ controls Famur and Famur-Famak, both producers and distributors of machinery and equipment for underground and opencast mining. The acquisition will see TDJ Equity IV take control of Kopex, another manufacturer of mining equipment.

The takeover works towards the development of Polski Kombajn Górniczy (the Polish Mining Combine), a programme creating a strong entity offering comprehensive services and equipment for the mining industry. The Combine is part of Poland’s larger Plan for Responsible Development, which envisages the expansion of strong Polish brands abroad.

UOKiK’s proceedings in the case showed that the markets the companies operate on are global in scale, and will not see competition restricted.
