UOKiK clears PKP Cargo to take over advanced world transport

Poland’s Office of Competition and Consumer Protection (UOKiK) has cleared PKP Cargo, Polish railway freight transport operator, to take over rail freight services provider Advanced World Transport. The Authority’s analysis concluded that the rail freight market has a national dimension — enterprises compete with one another on Polish territory. As such, there are barriers to entering the market, including the need to hold the required licenses and safety certificates as well as the high cost of investment required to operate in the sector, such as for the purchase of rolling stock adapted particularly for use in Poland. During its case proceedings UOKiK determined that though the combined participation of the two companies in the rail freight market will exceed 50%, that is largely attributable to the position of the PKP group. Advanced World Transport’s share is negligible, so the merger will not significantly change either the degree of concentration or the situation on the market.
