The Court of Competition and Consumer Protection has confirmed the decision of the President of UOKiK imposing a fine on Jeronimo Martins Dystrybucja. The owner of Biedronka supermarkets network provided incorrect data when notifying on the intended concentration

In January 2008, upon request of Jeronimo Martins Dystrybucja (JMD), proceedings were initiated regarding taking control over Plus Discount by the company. In September 2008 the President of UOKiK issued a conditional consent for the transaction.

According to the findings of the Office, the undertaking provided incorrect information in its request regarding the intention of concentration. It concerned the number of retail stores of concentration participants operating in Morąg. Therefore in December 2008, JMD was imposed a financial penalty amounting to PLN 100,000.

On 21 June 2010 the Court of Competition and Consumer Protection dismissed the undertaking’s appeal. The Court agreed with the Office’s decision and sustained the fine imposed on Jeronimo Martins Dystrybucja.

Pursuant to existing regulations, an undertaking which is the subject of a decision issued by the President of UOKiK may lodge an appeal to the Court of Competition and Consumer Protection. The verdict of the Court may be appealed against to the Court of Appeal.
