Illegal charges on motorway

Stalexport Autorstrada Małopolska violated the law by imposing unfair prices for driving the renovated section of the A4 motorway. Today, the Court of Competition and Consumer Protection dismissed the appeal of the undertaking against this decision.
The verdict of the court concerns the antitrust decision of April 2008. The Office decided then that Stalexport Autostrada Małopolska did not have the right to collect full toll for driving the motorway which did not fully meet requirements for this type of road. Renovation works (lasting from September 2007) of the section of a roadway made the driving time longer as well as caused significant traffic obstructions. At the peak moment on nearly 1/3 of the route between charge collection points there was a two-way traffic on one roadway, and the travel time was significantly prolonged.
The court decided that the appeal of the undertaking was not justifiable. It took the stance of UOKiK that the charge collected for driving the renovated section of the motorway should have been proportionally decreased. The court also maintained the financial penalty imposed on the undertaking - PLN 1.3 mln.
The undertaking may lodge an appeal to the Court of Appeal against the verdict of the Court of Competition and Consumer Protection.
