"Social bonds" - an investigation by the President of UOKiK
  • President of UOKiK Tomasz Chróstny has initiated an investigation against the following companies: Obligacje Społeczne Prosta SA, KFG SA, KFG Leasing sp. z o.o. and Prius29 Sp. z o.o.
  • From the reports received, it appears that the entrepreneurs are unlawfully suggesting that their offer is related to the functioning of the National Guarantee Fund (KFG) operating within the National Development Bank (BGK).
  • What further raises doubts is the entrepreneurs portraying offers of investment loans to themselves as "social bonds."

The President of UOKiK, as part of an ongoing investigation, examines the activities of the following companies, among others: Obligacje Społeczne Prosta SA, KFG SA, KFG Leasing sp. z o.o. and Prius29 Sp. z o.o. The reports received on the subject indicate that the companies use the term "social bonds," to propose to the consumers agreements of loans granted to the entrepreneur for financing the purchase or lease of a car to be used in transport services. According to the reports, these companies may be misleading consumers.

"The very names of the private companies KFG or Obligacje Społeczne (Social Bonds) can be misleading. They seem to unlawfully suggest links to the National Guarantee Fund operating within the National Development Bank or to financial instruments recognised by consumers, such as bonds. During the investigation, we will also take a closer look at the promised profit, the risks and the issue of collateral for the money lent to the companies, among other things. We have submitted notices to the Prosecutor's Office and the President of the Personal Data Protection Office," says Tomasz Chróstny, the President of UOKiK.

The President of UOKiK requested model contracts and explanations from the companies. The purpose of the investigation is to analyse the situation and determine whether there are grounds to charge the companies with violation of the collective interests of consumers or the use of illegal clauses.

The President of UOKiK conducts the investigation of the above-mentioned entrepreneurs in cooperation with the Polish Financial Supervision Authority (UKNF). Other entities i.e. the National Development Bank, the Bank Guarantee Fund and the Ministry of Finance are also looking into KFG companies. In their announcements, these institutions pointed out that there are no connections between the listed entrepreneurs and the National Guarantee Fund operating within BGK, no guarantee from the Bank Guarantee Fund for the invested money and that the UKNF and BFG logos are used illegally on the entrepreneurs' websites (after intervention, the logos were removed).
