Bid-rigging for renovation and construction services

- Two entrepreneurs were able to determine their offers in tenders for renovation and construction services in Warsaw and Lublin.
- UOKiK initiated proceedings in this case.
The Office of Competition and Consumer Protection initiated proceedings against two entrepreneurs from the Mazovian voivodship: Bioforma from Grabianów and PHU Magnum from Siedlce.
- We suspect that entrepreneurs have jointly agreed upon their activities in at least a few cases. It is forbidden. If they participate in the tender as separate entities, they cannot agree on offers - says Michał Holeksa, vice president of UOKiK.
The office's suspicions concern tenders for renovation and construction services in Lublin and Warsaw. Entrepreneurs could use the mechanism of placing and withdrawing offers there. If their proposals were the most advantageous, then the winner of the tender would refrain from signing the contract. It could have been deliberate action in order to make the customer choose the more expensive offer.
