• UOKiK will examine the tender for electronic surveillance system.

Electronic surveillance system allows for monitoring convicts who are serving their sentences outside prison.

“UOKiK initiated an investigation procedure to verify if the entrepreneurs who took part in the tender, organised by the Ministry of Justice, for modification and development of the current electronic surveillance system engaged in collusion” – says Marek Niechciał, the President of UOKiK.

Among others, the Competition Authority will examine whether the entrepreneurs participating as part of a consortium had the possibility to take part in the tender and execute the contract independently. This is a preliminary stage of UOKiK's activities, and at the moment, the proceedings are being conducted in a case, and not against the entrepreneurs.

What is important, UOKiK does not question, as a matter of principle, the possibility to form consortia for the purpose of tenders. However, according to the competition law, if the formation of a consortium is not necessary for participating in a tender, cooperation with other entities may result in restriction of competition.
