Multimedia - the decision of UOKiK
  • The President of UOKiK issued a decision concerning Multimedia Polska.
  • The company will refund its customers 2-month subscription fee and provide them with 50 minutes for calls or 5 GB of data transfer.
  • The operator avoided a fine, as it will remove the effects of its practices.

Multimedia Polska is a telecommunications operator offering services such as access to Internet and TV channels. The Office of Competition and Consumer Protection (UOKiK) had doubts about the process of concluding and amending agreements in 2015 and 2016. It analyzed telephone sales conversations and call scripts. Towards the end of 2016, proceedings were initiated against the operator.

Multimedia Polska incorrectly informed its subscribers the withdrawal period for the agreement on the provision of telecommunications services is shorter than stipulated by law. According to the Act on Consumer Rights, we have 14 days for it. The consultants said it was 10 days. According to the Act on Consumer Rights, we may also withdraw from the agreement if we already use the services. The undertaking's practice did not allow for it. Moreover, its clients did not receive a confirmation of terms and conditions to the agreement offered by phone. Therefore, they were not able to verify the actual conditions before accepting them.

Multimedia Polska agreed to change the practice and remove the effects of its actions. The company's proposal also concerns those consumers who ceased to use its services as
a result of the impugned practices. According to the UOKiK’s decision, the operator will inform consumers of the possibility to get a compensation. Consumers who were not able to withdraw from the agreement due to the company's refusal will receive a refund of
2-month subscription fee. Those who have already withdrawn from the agreement and had to return the previously granted discount, will get it back. Some consumers will receive benefits in the form of additional services, such as access to the movie catalogue,
50 minutes of mobile calls or 5 GB of data transfer. More details on the above commitment are provided in the UOKiK’s decision.
