Concentration clearances - four decisions

The Office of Competition and Consumer Protection issued four decisions in which it approved proposed concentrations. The relevant transactions concern enterprises conducting activities in the field of investment, heating technology, packaging production and sales of medicaments

The first of the above-mentioned concentrations concerns the establishment of a joint venture by Echo Investment and Echo Polska Properties. This new entity will be responsible for the construction and management of a shopping mall in Warsaw.

The Office also approved the acquisition of GTX Hanex Plastic by Marpol. The companies conduct their business activities in the field of production and sales of plastic packaging.

The green light was also given to Kewpie Poland, which will take-over part of the property of Mosso Kwa¶niewscy. The acquiring company, established for the purpose of conducting this transaction, belongs to the Japanese capital group Kewpie. The activities conducted by the parties to the concentration include inter alia the production of wet spices (e.g. mayonnaises and mustards).

The last of the above-mentioned decisions concerns the acquisition of Galenica Nova by Medicare. The business activity of both these companies consists primarily in the sales of pharmaceutical and medical products to pharmacies and hospitals.

According to the law, a transaction must be notified to the anti-monopoly office if it involves enterprises whose total turnover in the preceding year exceeded EUR 1 billion globally or EUR 50 million in Poland.

Concentration clearances expire if a transaction is not effected within two years from the issue date. The website of the Office provides information on all anti-monopoly concentration proceedings currently conducted by the Office. More information on enterprise mergers can be found in a special study.
