Poland's UOKiK issues decisions on furniture retailers' Agata Meble and Black Red White promotions

Consumer protection Authority (UOKiK) issues commitment decisions that will lead big box furniture retailers to return to consumers 10 percent of the purchase price on products bought in the first three months of 2015.
In early 2015, Agata Meble and Black Red White (BRW) advertised discounts on all stock in their stores, but failed to inform consumers that the discount did not apply to products covered by other promotions. BRW ran the promotions in January 2015, while Agata Meble featured them in February and March.
The companies’ advertisements claimed that shopping in their showrooms would entitle consumers to receive a 10 percent discount on the entire assortment of stock. Agata Meble further offered clients interest-free installment plans. In reality, however, clients could not apply the rebate to purchase products covered by other promotions. Furthermore, both advertisements failed to refer to the rules informing consumers of the actual conditions of the promotions.
Agata Meble and Black Red White voluntarily committed to compensate consumers for their losses. Clients who purchased goods in their stores in the periods being challenged are to receive a refund of 10% of the purchase price. Both enterprises will inform clients of UOKiK’s decision in Poland’s national daily newspapers.
