Poland's competition Authority approves four concentrations

Poland’s Office of Competition and Consumer Protection (UOKiK) issues four decisions granting approval for concentrations in the healthcare, coal, insurance and poultry industries.  

The first of the decisions clears medical care provider LuxMed to acquire Magodent, which primarily provides oncology services in Warsaw. While the takeover will affect the market for private medical services in the Warsaw metropolitan area, it is not expected to limit competition, as LuxMed can count on continued competition from large medical centres and smaller private healthcare providers alike.

In its second decision, the Authority cleared the JSW Koks company and the Industrial Development Agency to jointly build a power plant in the city of Radlina in Silesia. The two enterprises will set up a joint venture in which JSW will contribute real estate and the complete documentation for the investment as well as oversee the project design and administrative-legal matters, while IDA will fund the project. A subsidiary of the JSW Group, JSW Koks manufactures, processes and sells coal and coal derivatives. The Industrial Development Agency is a state-owned company that supports the restructuring and development of Polish enterprises by providing financial services, marketing and advisory services. The two capital groups operate on entirely different markets, so the project poses no threat to competition.

The third approval went to insurance and reinsurance provider Aviva Towarzystwo Ubezpieczeń na Życie in its bid to acquire Expander Advisors, which engages in brokerage and financial advisory services across Poland. While the two enterprises do overlap on the financial services market, their combined share amounts to only a few percent.

The last of the decisions paves the way for Drosed Surowiec to acquire Pol-Pasz. Drosed breeds chicks, wholesales live poultry and produces fodder while Pol-Pasz engages primarily in the production of fodder for poultry and cattle. UOKiK’s analysis of the takeover showed that the transaction would not limit competition in the poultry feed market.
