Poland's competition Authority approves two energy market takeovers

UOKiK clears GAS Assets Management, a PGNiG subsidiary, to take over the capital group Bartimpex Foreign Trade Enterprise and The PGNiG Group and GAS Assets Management to assume control of the company Gas-Trading.

Poland’s Office of Competition and Consumer Protection (UOKiK) has conducted a proceeding that showed that the energy market consolidation will not significantly limit competition. PGNiG heads a group that produces, transports and sells gas, and also explores for and produces crude oil and natural gas. While it commands a strong position on numerous markets, the Authority has stated that its dominance will not carry over into the market on which Bartimpex and Gas-Trading operate. Further, the takeover will not change the situation at EuRoPol Gaz, which owns the Polish section of the Yamal-Europe gas pipeline. Gas Trading currently owns 4% of EuRoPol, while PGNiG and Gazprom control 48% each of the company’s shares and votes.

The Polish Oil and Gas Company heads up a group that produces, transports and sells gas, as well as explores for and extracts crude oil and natural gas.

GAS Asset Management (GAM) is the newly formed subsidiary of PGNiG that will operate Gas-Trading.

Bartimpex Foreign Trade Enterprise heads a group that manages holding companies and real estate.

GAS-Trading is a consumer goods wholesaler that also owns shares in the capital of EuRoPol Gaz.
