Poland's competition Authority approves another merger on coal market

UOKiK rules that Węglokoks ROW’s purchase of four coal mines from Kompania Węglowa will not limit competition on the coal market.

Poland’s Office of Competition and Consumer Protection (UOKiK) has given coal producer Węglokoks Rybnicki Okręg Wydobywczy, seeking to purchase a thermal coal resource base, the go-ahead to acquire four mines from Kompania Weglowa, also a mining company. Węglokoks will support the mines, enabling a restructuring and the subsequent maintenance of their operations. Węglokoks ROW is a subsidiary of the Węglokoks group, which engages in the wholesale trade of coal, energy raw materials and the manufacture of steel products. The Kompania Węglowa capital group owns an array of companies, mines, and other specialised facilities.  

UOKiK’s analysis of the merger showed that the transaction will not affect the thermal coal market in which the mines to be taken over operate as the other companies Weglokoks owns do not operate on this market. The Authority likewise determined that the merger will not limit competition on the domestic markets of the production and sale of mine roadway and mining components including stirrups, racks and treads, which are produced by Huta Łabędy, a Węglokoks subsidiary which sells to mines owned by Kompania Węglowa. The company’s sales account for such a small share of the market that Huta Łabędy’s market position is unlikely to see a significant change as a result of the merger.
