Coal mine merger in Poland receives approval

Poland’s UOKiK has approved a merger on the coal market, determining that Węglokoks Kraj’s purchase of assets from Kompania Węglowa will not limit competition on the market.

Poland’s Office of Competition and Consumer Protection (UOKiK) has given coal producer Węglokoks Kraj the go-ahead to acquire two mines, KWK Bobrek and KWK Piekary, from Kompania Weglowa, also a mining company. Belonging to the Węglokoks group, which engages in the wholesale trade of coal and energy raw materials and the production of steel products, Węglokoks Kraj enriches and sells thermal coal culm in Poland. The Kompania Węglowa capital group owns 22 companies, 14 mines, and five specialised units.

UOKiK’s analysis of the merger showed that it will not impact the thermal coal market on which the mines operate. The companies that already belong to Weglokoks do not operate on this market. The Authority likewise determined that the merger will not limit competition on the domestic markets of the production and sale of mine roadway and mining components including stirrups, racks and treads, which are produced by Huta Łabędy, a Węglokoks subsidiary which sells to mines owned by Kompania Węglowa. The company’s sales account for such a small share of the market that Huta Łabędy’s market position is unlikely to see a significant change as a result of the merger.
