The President of UOKiK has instituted proceedings to examine TV advertisements of consumer loans offered by three banks

Under the applicable law, UOKiK may initiate an investigation procedure which is always carried out to look into a specific case and not against the entrepreneur concerned. Its aim is to obtain a preliminary assessment of the market situation. The latest investigation procedure instituted by the President of UOKiK is intended to establish whether or not Bank Gospodarki Żywnościowej, Bank Polska Kasa Opieki and Euro Bank have contravened the law by advertising consumer loans. The Office of Competition and Consumer Protection has been analysing their TV advertisements, which have been broadcast since 1 April 2014.

The investigation procedure should be completed within 30 days or, in particularly complicated cases, within 60 days of its commencement. However, the above-mentioned time limits may be extended, for example, pending the receipt of information which entrepreneurs are requested to provide UOKiK with. If any irregularities are discovered in the course of the inquiry, the President of UOKiK may institute proceedings with respect to practices violating the collective interests of consumers.
