The Office of Competition and Consumer Protection has launched today explanatory proceedings within which the Office will analyse the structure of the market and the cooperation rules among the operators of mobile telephony
UOKiK monitors the telecommunication sector on a regular basis, taking into account its dynamic changes and technological development.
The President of UOKiK has instituted today explanatory proceedings to determine whether the activities of the telecom operators regarding cooperation consisting in giving access, combining and sharing telecommunication networks, infrastructure or frequency resources lead to a restriction of competition.
The information gathered during the proceedings will give a closer look at the sector, and allow the Office to verify the signals coming from entrepreneurs and experts directly to the Office or in the framework of public consultations.
According to the antimonopoly law, the Office may initiate explanatory proceedings, which are always conducted “in a case”, not against a particular entrepreneur, and aim at
initial examination of the situation on the market. The explanatory proceedings should not exceed 30 days, and as regards particularly complex cases, 60 days counted from the date of the institution thereof. These time limits may, however, be extended, e.g. when the Office waits for provision of the necessary information by the entrepreneur. When irregularities are found during the explanatory proceedings, the President of the Office may institute an antimonopoly proceedings concerning competition restricting practices.
