Consent to the takeover in cable railways

The cable railway to Kasprowy Wierch changes hands. The President of UOKiK has given her consent to the takeover of Polskie Koleje Linowe by  Polskie Koleje Górskie  (a company set up by the local government)

Polskie Koleje Górskie (PKG) is the undertaking co-owned by Miasto Zakopane and the following municipalities: Bukowina Tatrzańska, Kościelisko and Poronin. This entity was created to exert control over Polskie Koleje Linowe (PKL, Polish Cable Railway) under privatisation process. To obtain funds necessary to the transaction, PKG entered into the investment agreement with Mid Europa Partners, a company belonging to a capital group being the shareholder of companies such as Żabka Polska, or Alpha Medical Polska.

Polskie Koleje Linowe deal with passenger transport by cable railway, operating ski-lifts and conveyor belts in the following resorts: Góra Parkowa, Gubałówka, Kasprowy Wierch, Mosorny Groń, Palenica (Nowy Sącz region) and Góra Żar (Bielsko region). As a result of concentration, PKG will acquire from PKP 100% of shares of Polskie Koleje Linowe.

Having conducted the antimonopoly proceedings, the President of UOKiK decided that this concentration would not result in a significant restriction of competition.

Under the law, any transaction is subject to notification to the antitrust authority if it involves undertakings whose total turnover achieved in the preceding year exceeds EUR 1 billion worldwide or EUR 50 million in Poland.

Decisions granting consent to implement a concentration expire if the merger is not completed within 2 years from the decision issue date.
