The President of the Office of Competition and Consumer Protection, Marek Niechciał, initiated an anti-trust proceeding to check whether Plannja concluded an unlawful agreement with its nine clients
The information possessed by the Office shows that Plannja, a roofing sheet manufacturer, concluded an agreement with its distributors, which may have restricted competition. The analysis of the contracts concluded by the company with its largest trading partners showed that the enterprises agreed the price of re-sale of roofing sheet. During the proceeding the President of UOKiK will check whether the enterprises exceeded the permitted forms of cooperation by undertaking actions aimed at restricting or eliminating competition from the market.
Joint fixing of prices is one of the most serious infringements of anti-trust law. The negative consequences of unlawful agreements concluded by enterprises also affect the situation of consumers as they make it impossible for the weaker market participants to benefit from broader price and quality offer.
According to the Act on competition and consumer protection, an anti-trust proceeding should finish not later than in five months of the date of its launch. If the charges are confirmed, the President of the Office may order the company to abandon the questioned practice and impose a fine of up to 10% of the enterprise’s previous year’s income.

INWESTOR in Lublin.
